North Peace Savings and Credit Union Privacy Code

North Peace Savings and Credit Union respects and understands the privacy of our members and will continue our commitment to confidentiality and security of member personal information.

To protect your privacy and your right to control the collection, use and disclosure of your personal information, we have in place Policies and Procedures, and appointed a Privacy Officer in maintaining confidentiality.

Definitions

"Pipeda" – refers to the Personal Information Protection and Electronic Documents Act, which is the Canadian federal legislation governing privacy in the private sector, which became law on January 1, 2001. On January 1, 2004, PIPEDA will apply to all commercial activities carried on in a province unless the province passes substantially similar legislation.

An organization, other than a federal work, undertaking or business, to which the Personal Information Protection Act, S. B. C. 2003, C. 63, of the Province of British Columbia, applies is exempt from the application of part 1 of the Personal Information Protection and Electronic Documents Act, in respect of the collection, use and disclosure of personal information that occurs with the Province of British Columbia.

"Collection" - the act of gathering, acquiring, or obtaining personal information from any source, including third parties, by any means.

"Consent" – a voluntary agreement with what is being done or proposed. Consent may be expressed or implied. Express consent is given explicitly, either orally or in writing. Express consent is unequivocal, and does not require any inference on the part of North Peace Savings and Credit. Implied consent arises where consent may reasonably be inferred from the action or inaction of the member.

"Member" - is any individual who uses, or applies to use, financial services with North Peace Savings and Credit.

"Disclosure" - the act of making personal information available to others outside of North Peace Savings and Credit Union.

"Use" - the treatment and handling of personal information by and within North Peace Savings and Credit Union.

"Personal Information" – is information about an identifiable individual that is recorded in any form; but excludes the individual's name, business title, business address and business phone number.

"Third-Party" - an individual or organization other than North Peace Savings and Credit Union and the member.

Section 1: Accountability

North Peace Savings and Credit Union is committed to protecting the personal information of its members.

North Peace Savings and Credit Union will designate a Privacy Officer to oversee the protection of personal information and North Peace Savings compliance with the Privacy Code and the policies and procedures governing personal information.

North Peace Savings and Credit Union will identify the Privacy Officer to its members.

North Peace Savings and Credit Union will develop policies and procedures to:

  • protect personal information;
  • receive and respond to complaints and inquires;
  • train staff regarding the policies and procedures;
  • and communicate the policies and procedures to members.

North Peace Savings and Credit Union will use contractual or other reasonable means to ensure that a comparable level of personal information protection is implemented by the suppliers and agents who assist in providing services to members.

Section 2: Identifying the Purposes of Personal Information

North Peace Savings and Credit Union shall make reasonable efforts to ensure that a member is aware of the purposes for which personal information is collected when or before the time the information is collected.

The purpose for which North Peace Savings and Credit Union collects personal information are as follows:

  • to contact the member;
  • to identify the member;
  • to determine the eligibility of the member for products and services;
  • to determine the suitability of products or services for the member;
  • to develop, offer and manage products and services that meet member needs;
  • to detect and prevent fraud;
  • to safeguard the financial interests of North Peace Savings and Credit Union.
  • to access creditworthiness; and
  • to meet regulatory requirements

Section 3: Member Consent

North Peace Savings and Credit Union will obtain the consent of the member for the collection, use or disclose any personal information except in specific circumstances permitted by the governing legislation.

North Peace Savings and Credit Union shall not, as a condition of the supply of a product or service, require a member to consent to the collection, use or disclosure of personal information beyond that required to fulfill explicitly specified and legitimate purpose.

North Peace Savings and Credit Union shall whenever possible obtain a member’s express consent to the collection, use and disclosure of personal information. Implied consent may be appropriate in limited circumstances, but North Peace Savings and Credit Union shall take into account the sensitivity of the personal information.

A member can give consent: (a) in writing, such as when completing and signing an application; (b) through inaction, such as not checking a box indicating that they do not wish their names and addresses to be used for optional purposes; (c) orally, such as when information is collected over the telephone or in person; (d) at the time they use a product or service; and (e) through an authorized representative, such as a legal guardian or a person having power of attorney.

A member may withdraw consent at any time, subject to legal or contractual restrictions, provided that: (a) reasonable notice of withdrawal of consent is given to North Peace Savings and Credit Union; (b) the consent does not relate to a credit product requiring the collection and reporting of personal information after credit has been granted; (c) the withdrawal of consent is in writing; and (d) the member understands that North Peace Savings and Credit Union may subsequently not be able to provide the member with related products or services.

Section 4: The Collection of Personal Information

The collection of personal information shall be limited to that which is necessary for the purposes identified by North Peace Savings and Credit Union.

Section 5: Limiting Using, Disclosure and Retention

North Peace Savings and Credit Union shall not use or disclose personal information for purposes other than those for which it was collected, except with the consent of the member or as required by law.

When disclosing personal information North Peace Savings and Credit Union will take all reasonable steps to protect the interests of its members.

North Peace Savings and Credit Union may share personal information with its subsidiaries and affiliated companies with the consent of the member and as permitted by law.

North Peace Savings and Credit Union will retain personal information only as long as necessary to fulfill the identified purposes or as required by law. Personal information that has been used to make a decision about a member shall be retained long enough to allow the member access to the information after the decision has been made.

Section 6: Accuracy

North Peace Savings and Credit Union will make reasonable efforts to ensure that the personal information it collects, uses and discloses is accurate, complete and up to date.

North Peace Savings and Credit Union will update personal information only as necessary to fulfill the purposes for which the information is collected or as required to service membership privileges or maintain an active account.

North Peace Savings and Credit Union will encourage members to assist in keeping their personal information current. North Peace Savings and Credit Union will inform members how to verify and correct their personal information.

Whenever possible, North Peace Savings and Credit Union will ensure that personal information disclosed to third parties, such as suppliers and agents who assist in providing services to members, is accurate.

Section 7: Safeguards

North Peace Savings and Credit Union and its directors, officers and employees are committed to safeguarding member’s personal information against loss, theft and unauthorized access, use, copying, modification, disclosure and disposal.

North Peace Savings and Credit Union will employ electronic and physical security safeguards appropriate to the sensitivity level of personal information.

North Peace Savings and Credit Union will use various security measures including: physical measures such as locked fire resistant filing cabinets and restricted access to offices; organizational measures such as restricting employee access to files and data centers; electronic measures such as passwords and encryption; and investigative measures such as where North Peace Savings and Credit Union has reasonable grounds to believe that personal information is being inappropriately collected, used or disclosed.

Third parties providing services to North Peace Savings and Credit Union, including cheque printing and date processing, must safeguard personal information disclosed to them in a manner consistent with policies of North Peace Savings and Credit Union.

North Peace Savings and Credit Union will take due care with the destruction of personal information so as to prevent unauthorized partied form gaining access to the information.

Section 8: Openness

North Peace Savings and Credit Union will make available to members information about its policies and practices relating to the management of personal information.

North Peace Savings and Credit Union will communicate information to members in a format that is generally understandable.

The Information made available will include:

  • The title and address of the Privacy Officer;
  • The means of gaining access to personal information;
  • A description of the type of personal information held by North Peace Saving and Credit Union;
  • A copy of brochures and other member information that explain the policies and procedures;
  • The type of personal information made available to service suppliers and related organizations such as subsidiaries and affiliated companies;
  • Advice regarding the process for making inquiries and complaints.

Section 9: Access

Upon request, North Peace Savings and Credit Union shall inform a member of the existence, use, disclosure and if possible, the source of personal information about the member held by North Peace Savings and Credit Union and shall allow the member access to the information.

A member may be required to provide sufficient information to permit North Peace Savings and Credit Union to provide an account of the existence, use and disclosure of personal information it holds. The additional information provided shall only be used for this purpose.

North Peace Savings and Credit Union shall respond to a member’s request within a reasonable time at a reasonable cost to the member. The information shall be provided in a form that is generally understandable.

If a member demonstrates the inaccuracy or incompleteness of personal information, North Peace Savings and Credit Union shall amend the information as required. If appropriate, the amended information shall be transmitted to third parties with access to the information at issue.

When a challenge regarding the accuracy of personal information is not resolved to the satisfaction of the member, the substance of the unresolved challenge shall be recorded by North Peace Savings and Credit Union. If appropriate, the existence of the unresolved challenge shall be transmitted to third parties with access to the information at issue.

Section 10: Challenging Compliance and Complaints

Members may direct any inquires or complaints regarding their personal information to the Privacy Officer.

North Peace Savings and Credit Union will inform members of its complaint procedures, which will be accessible and simple to use.

North Peace Savings and Credit Union will ensure that inquiries, concerns and complaints regarding personal information receive prompt attention and are resolved in a timely manner.

How Does North Peace Savings and Credit Union collect information about me?

North Peace Savings and Credit Union collects personal information from you directly when you open an account and/or apply for more products and services. Some personal information we collect is required by law to ascertain your identity. With your consent, North peace Savings and Credit Union also collects information from credit reporting agencies, references provided by you, your employer, and others, when you apply for credit and other products and services.

Your consent can be expressed or implied.

Do I have to provide my Social Insurance Number (Sin) or Business (BN)?

North Peace Savings and Credit Union is required by law to obtain your SIN or BN from you to report on your deposits and dividends on your shares and other investment income to Canada Customs and Revenue Agency. Also, when North Peace Savings and Credit Union deals with the credit bureau, using your SIN or BN is the best way to make sure the credit information is about you, not someone else with a similar name. However, use of your SIN or BN for this purpose is voluntary. If you choose not to authorize us to use your SIN or BN for this purpose, you will not be denied credit or other services.

Can I decline to have my personal information collected, used, or disclosed for certain purposes?

Yes, you can decline to have your personal information collected, used, or disclosed for certain purposes. For example, you can opt out of the use of your personal information for marketing purpose, such as:

receiving information from North Peace Savings and Credit Union about products and services or special promotions. sharing your information with other carefully selected organizations for the purpose of providing you with information about products and services.

To choose these options, please contact us and ask for an opt-out request form. You can also decline to have your personal information collected, used, or disclosed for other purpose. This may mean that North Peace Savings and Credit Union will not be able to provide you with products and services.

What will happen if I opt out of marketing purpose?

If you opt out of receiving marketing information from North Peace Savings and Credit Union, you may no longer receive information about new products and services or special promotions, financial information, North Peace Savings and Credit Union newsletters, or activities and events. North Peace Savings and Credit Union will continue to send you account statements, including statement inserts, and information required by law such as notices of membership meetings. Your request may take some time to take effect. Your request to opt out of receiving marketing information will not affect your eligibility for any products and services.

How does North Peace Savings and Credit Union protect my personal information?

North Peace Savings and Credit Union staff is required to treat all personal information confidentially. North Peace Savings and Credit Union has many policies, practices, and physical and electronic systems in place to safeguard personal information under North Peace Savings and Credit Union’s control, and to prevent unauthorized access, collection, use, disclosure, copying, modification, or disposal of your personal information.

What can I do to protect my personal information?

If you use North Peace Saving and Credit Union ‘s online banking, automated telephone banking, r telephone call services, or you have a MemberCard (debit card); you must select personal security codes and numbers (example: PAC , PIN). It is your personal responsibility to protect this information form misuse. You should safeguard your account and credit card statements, blank cheques, and your personal codes and numbers at all times. You should not send confidential information to North Peace Savings and Credit Union or anyone else by using Internet email that is not encrypted. You should review your account statements carefully and let us know immediately if your address changes or you find any errors in your information.

Can I view and verify my personal information?

North Peace Savings and Credit Union has always provided members and account holders with copies of account statements, cheques, transaction slips, or other documents upon request, if we still have them. North Peace Savings and Credit Union may charge a fee for providing copies of documents.

For more extensive information, you can complete an access to information request. You will be provided with an estimate of the fee for obtaining the information. For information and assistance, please contact the Privacy Officer. We’ll respond within 30 days or if we need an extension of time, we’ll notify you of the new deadline and the reason for the extension. If you ask, we will assist you to contact other organizations to which we have disclosed your information. By law, North Peace Savings and Credit Union must not provide or may withhold some types of information. For example, North Peace Savings and Credit Union will not provide information that reveals the identity of another individual or that individual’s personal information without that individual’s consent, information that cannot be disclosed for legal or security reasons, or information that is confidential commercial information. If there are any errors in your information, we will correct the information wherever possible. If you wish to verify your credit history, please contact the credit bureau directly. We will help you to contact the credit bureau.

How long does North Peace Savings keep my information?

North Peace Savings and Credit Union keeps your personal information as long as it is needed to provide you with products and services you have applied for and to meet legal and business requirements, after which the information is destroyed or erased, or we remove you name from the information. With your consent, North Peace Savings and Credit Union may keep use personal information in the past when you apply for new products and services, in which case, North Peace Savings and Credit Union confirms or updates your information, and for marketing purpose, such as sending you information about products and services that maybe of interest to you.

Commitment - The Credit Union is committed to ensuring the confidentiality and privacy and protecting the personal information of all members and other individuals whose personal information is held or controlled by the Credit Union.

Privacy Officer - The Credit Union will designate a Privacy Officer and an alternate to oversee the protection of personal information in compliance with the BC Financial Institutions Act, the BC Personal Information Protection Act, and the Credit Union’s privacy policies and practices.

Policies - The Credit Union will develop policies and practices necessary for compliance with the Personal Information Protection Act and a process to respond to complaints that may arise, and make information available on request about the policies and practices and the complaint process.

Consent - The Credit Union will obtain consent for the collection, use, and disclosure of personal information, except in circumstances permitted by the Personal Information Protection Act or other law.

Conditions - The Credit Union will not, as a condition of providing a product or service, require an individual to consent to the collection, use, or disclosure of personal information beyond what is necessary to provide the product or service.

Express Consent - The Credit Union will obtain express written or oral consent to the collection, use and disclosure of personal information, except in circumstances when the Personal Information Protection Act authorizes the collection, use, or disclosure without consent or deems the collection, use, or disclosure to be consented to.

Implicit Consent - Implied consent may be relied on when the purpose would be considered obvious to a reasonable person and the individual voluntarily provides the personal information for that purpose.

Deemed Consent - The Credit Union may obtain consent to collect, use, or disclose personal information for specified purposes, if the Credit Union sends notice to the individual that it intends to collect, used or disclose personal information for those specified purposes and gives the individual a reasonable opportunity to decline to have the personal information collected, used, or disclosed for those purposes, the individual does not decline the collection, use, or disclosure for those purposes, and the collection, use or disclosure is reasonable having regard to the sensitivity of the personal information in the circumstance.

Withdrawal - An individual may withdraw consent at any time, subject to legal or contractual restrictions, provided that reasonable notice of withdrawal of consent is given to the Credit Union. On receipt of notice of withdrawal of consent, the Credit Union will inform the individual of the likely consequences of the withdrawal of consent, which may include the inability of the Credit Union to provide certain products or services, if the information is necessary to provide the products and services.

Purposes - When collecting information, the Credit Union will state the purpose of collection and provide on request the position or title and contact information for an officer who can answer the individual’s questions about the collection.

Collection - The Credit Union will limit the collection of information to information that is necessary to provide a product or service or that is necessary for the purpose consented to by the individual or to information otherwise permitted to be collected by the Personal Information Protection Act or other law.

Use - The Credit Union will not use personal information for purposes other than those for which it was collected, except with the consent of the member or as required or authorized by law.

Disclosure - The Credit Union will not disclose personal information for purposes other than those for which it was collected, except with the consent of the member, account holder, or other individual or as required or authorized by law. When disclosing personal information the Credit Union will take all reasonable steps to protect the interests of its members and other individuals.

Sharing - The Credit Union may share personal information with its subsidiaries and other carefully selected organizations with the consent of the member or as required or authorized by law.

Access - Member and account holder information, such as copies of statements, transaction slips, and account agreements, will be provided upon request. The Credit Union may charge a fee for doing so. For other information, upon written request, the Credit Union will provide the individual with the personal information under the control of the Credit Union, information about the ways in which the personal information requested has been and is being used, and the names of individuals and organizations to whom the personal information requested has been disclosed. The Credit Union may charge a minimal, fee for providing information. The Credit Union will provide an estimate of the fee upon receiving the access to information request. The Credit Union may require a deposit for all or part of the fee.

Assistance - The Credit Union will assist individuals to complete an access to information request to ensure that the information wanted or needed is provided accurately, completely, and promptly. An applicant may be required to provide sufficient information to permit the Credit Union to provide an account of the existence, use, and disclosure of personal information it holds. The additional information provided will only be used for this purpose.

Exceptions - The Credit Union may not provide information that it is not required to disclose and will not disclose information that it is required not to disclose by law, such as information that would reveal the identity of another individual without his or her consent.

Time Limit - The Credit Union will endeavour to respond to an access to information request within 30 days. If additional time is required because sufficient detail has not been provided by the applicant, a large amount of material is requested or must be retrieved, or more time is needed to consult with other organizations, the Credit Union may apply to the BC Privacy Commissioner for an extension under the Personal Information Protection Act.

Refusals - If the Credit Union refuses access to personal information, the Credit Union’s response to the access to information request will provide the reasons for refusal and provide the name, position/title, address, and telephone number of an officer of the Credit Union who can answer the applicant’s questions about the refusal. The Credit Union may refuse to confirm or deny the existence of personal information collected as part of an investigation.

Accuracy - The Credit Union will make a reasonable effort to ensure that personal information it is using or disclosing is accurate and complete.

Corrections - If an individual demonstrates the inaccuracy or incompleteness of personal information, the Credit Union will amend the information as required. If appropriate, the Credit Union will send the amended information to third parties to whom the information has been disclosed. When a challenge regarding the accuracy of personal information is not resolved to the satisfaction of the individual, the Credit Union will annotate the personal information under its control with a note that the correction was requested but not made.

Protection - The Credit Union will protect the personal information in its custody or control by making reasonable security arrangements to prevent unauthorized access, collection, use, disclosure, copying, modification, disposal, or similar risks. The Credit Union will take reasonable steps, through contractual or other reasonable means, to ensure that a comparable level of personal information protection is implemented by the suppliers and agents who assist in providing services to members, account holders, and other individuals.

Retention - The Credit Union will keep personal information used to make a decision that affects the individual for at least one year after using it to make the decision.

The Credit Union will, in accordance with its retention schedule, destroy, erase, or make anonymous documents containing personal information, as soon as it is reasonable to assume that the original purpose is no longer being served by retention of the information and retention is no longer necessary for legal or business purposes. The Credit Union may retain personal information about members and account holders with their consent in order to assist in the provision of future products and services and for marketing purposes, such as sending information about products and services that may be of interest, and may update the information as necessary to provide products and services applied for. The Credit Union will take due care with the destruction of personal information so as to prevent unauthorized parties from gaining access to the information.

Safeguarding - The Credit Union will employ electronic and physical security safeguards appropriate to the sensitivity level of personal information, including:

  • physical measures such as locked fire resistant filing cabinets and restricted access to offices
  • organizational measures such as restricting employee access to files and databases
  • electronic measures such as passwords and encryption
  • investigative measures if the Credit Union has reasonable grounds to believe that personal information is being inappropriately collected, used, or disclosed.

Questions - Members and other individuals may direct any inquiries or complaints regarding their personal information to the Credit Union’s Privacy Officer. Contact information will be available by inquiring at any office or call centre of the Credit Union.

Complaint Process

The Credit Union will, on request, inform members and other individuals of its complaint procedures, which will be accessible and simple to use.

The Credit Union will ensure that inquiries, concerns, and complaints regarding personal information receive prompt attention and are resolved in a timely manner.

Where appropriate, members and other individuals will be informed of their right to file a complaint with the BC Privacy Commissioner and will be provided with contact information.
